Contracts

A "contract" is an agreement between parties to do, or not to do, something. They can, generally, be verbal or written, however, written contracts are easier to prove and enforce. Under Georgia law, you can enforce most verbal contracts up to 4 years after a problem or "breach" has occurred. Written contracts can be enforced for up to 6 years.

The "terms" of a contract are crucial. They specify your rights and obligations. Without a written contract, you may not be entitled to charge late fees or interest or recover attorney's fees.

By clearly defining obligations, a properly drafted contract can protect you from problems before they occur. And, if they occur, a well written contract can help recover your losses.
